Terms & Conditions

Rov’s Rubbish Removal Pty Ltd
Last updated: September 2026

These Terms & Conditions apply to services supplied by Rov’s Rubbish Removal Pty Ltd (“Rov’s”, “we”, “us” or “our”).

They are intended to clearly set out the responsibilities of Rov’s and our customers and apply to rubbish removal, waste collection, green waste removal, property clean-ups, deceased estate clean-ups, hoarder clean-ups, property maintenance, vegetation clearing, excavation, earthmoving, machine work, material removal, mobile skip bin services and any other services supplied by Rov’s.

By requesting, accepting or proceeding with a quote, booking, work order or service from Rov’s, the customer (“you” or “your”) agrees to these Terms & Conditions.

Where a written quotation, work order or service-specific agreement contains terms that differ from these general Terms & Conditions, the specific written terms relating to that particular service will apply to the extent of the inconsistency.

Separate conditions also apply to Rov’s Mobile Skip Bin Hire and should be read together with these Terms & Conditions where applicable.

1. QUOTES AND SCOPE OF WORKS
All quotes are based on the information reasonably available to Rov’s at the time the quote is prepared.

This may include:

  • photographs supplied by the customer;
  • videos supplied by the customer;
  • written or verbal descriptions;
  • measurements or quantities supplied by the customer;
  • site inspections;
  • estimated waste volumes or weights;
  • the apparent type and condition of materials;
  • accessibility of the site;
  • visible ground and site conditions; and
  • the scope of work discussed with the customer.

Unless expressly stated otherwise, a quote covers only the work specifically described in the quote or agreed scope of works.

Work that is not reasonably apparent at the time of quoting, or that falls outside the agreed scope, is not automatically included in the quoted price.

Customers must provide accurate and complete information about the work required.

2. ESTIMATES BASED ON PHOTOGRAPHS OR CUSTOMER INFORMATION
Where a quote or estimate is provided without an on-site inspection, Rov’s relies on the accuracy and completeness of the photographs, measurements, descriptions and other information supplied by the customer.

Photographs can make the volume, weight, density, accessibility or nature of waste appear different from the actual conditions encountered on site.

If, upon arrival, Rov’s determines that the work is materially different from what was represented when the quote was prepared, Rov’s may:

  • discuss a variation to the scope or price with the customer;
  • provide a revised quote;
  • complete only the originally agreed scope;
  • postpone the work until a revised scope is agreed; or
  • decline to undertake work that cannot safely or lawfully be completed.

Rov’s will not undertake materially additional chargeable work without obtaining the customer’s agreement, except where immediate action is reasonably necessary to protect people, property or the environment.

3. UNFORESEEN AND LATENT CONDITIONS
Rov’s cannot always identify hidden or unexpected site conditions before work begins.

Examples include:

  • buried rubbish or building materials;
  • underground concrete;
  • hidden tree roots or stumps;
  • rock or unusually hard ground;
  • contaminated soil;
  • asbestos or suspected asbestos-containing material;
  • underground tanks;
  • hidden structures;
  • concealed pipes, cables or services;
  • unstable structures;
  • waterlogged or unstable ground;
  • unexpected waste underneath visible waste;
  • vermin, insects or animal infestations;
  • syringes, sharps or biological hazards;
  • hazardous chemicals;
  • human or animal waste;
  • inaccessible materials;
  • structural deterioration;
  • additional layers of material;
  • unexpected weight or density of waste; or
  • any other condition that could not reasonably have been identified when the work was quoted.

Where an unforeseen condition materially affects the work, Rov’s may suspend the affected work and discuss the available options with the customer.

Additional work will be treated as a variation and may involve additional labour, machinery, transport, tipping, disposal, testing, specialist contractor or other reasonable costs.

4. VARIATIONS AND ADDITIONAL WORK

A variation may be required where:

  • the customer requests additional work;
  • the quantity of waste is greater than originally advised;
  • the waste is heavier or denser than represented;
  • the waste type differs from what was disclosed;
  • additional labour or machinery is required;
  • site access differs from what was disclosed;
  • dismantling, cutting or demolition is unexpectedly required;
  • prohibited or hazardous material is discovered;
  • waste requires specialist disposal;
  • ground or site conditions differ from what was reasonably expected;
  • additional trips or loads are required; or
  • circumstances outside the original agreed scope arise.

Where practicable, Rov’s will explain the variation and associated costs before undertaking the additional work.

The customer may choose not to proceed with the additional work. In this case, the customer remains responsible for work already completed and reasonable costs already incurred.

WASTE AND HAZARDOUS MATERIALS
5. CUSTOMER RESPONSIBILITY TO DISCLOSE WASTE TYPES

The customer must tell Rov’s before work begins if any waste or material at the property is known or suspected to contain hazardous, contaminated, restricted or unusual material.

Customers must not deliberately conceal, mix, cover or misrepresent prohibited waste as general waste, green waste, clean fill or another category of waste.

Waste disposal facilities charge different rates and apply different conditions depending on the type, weight and contamination level of the material.

If waste is incorrectly described, additional disposal, transport, handling or specialist costs may apply.

6. PROHIBITED AND RESTRICTED WASTE

Unless Rov’s has expressly agreed in writing in advance to handle a particular material and is legally permitted and appropriately equipped to do so, the following materials must not be included in waste being collected by Rov’s.

Hazardous and Dangerous Materials:

  • asbestos;
  • suspected asbestos-containing material;
  • unidentified or potentially asbestos-containing fibro;
  • hazardous chemicals;
  • poisons;
  • pesticides;
  • herbicides;
  • solvents;
  • acids;
  • alkalis;
  • industrial chemicals;
  • fuels;
  • petrol;
  • diesel;
  • flammable liquids;
  • explosives;
  • ammunition;
  • fireworks;
  • radioactive material;
  • gas cylinders;
  • fire extinguishers;
  • compressed gas containers;
  • infectious or clinical waste; and
  • any substance classified as dangerous, hazardous, controlled or trackable waste under applicable law.

Paints, Oils and Liquids
Unless specifically agreed:

  • paint;
  • paint tins containing liquid paint;
  • varnish;
  • thinners;
  • oils;
  • lubricants;
  • liquid chemicals;
  • liquid concrete products;
  • wet concrete;
  • concrete washout; and
  • unidentified liquids
  • are not accepted as ordinary general rubbish.

Batteries and Electrical Hazards
Unless specifically agreed:

  • lithium-ion batteries;
  • damaged batteries;
  • vehicle batteries;
  • loose rechargeable batteries; and
  • other potentially hazardous battery products must not be concealed within general waste.

Biological, Sanitary and Putrescible Waste
Rov’s does not accept the following as ordinary general rubbish unless expressly agreed in writing:

  • food waste;
  • decomposing food;
  • perishables;
  • commercial food waste;
  • human faeces;
  • human urine;
  • bodily fluids;
  • sanitary waste;
  • soiled nappies;
  • animal faeces;
  • animal urine;
  • deceased animals;
  • animal remains;
  • contaminated animal bedding;
  • kitty litter or cat litter containing animal waste;
  • veterinary waste;
  • medical waste;
  • syringes;
  • needles;
  • sharps;
  • or other biological or infectious material.

Other Restricted Materials
Depending on the disposal facility and circumstances, restrictions or additional charges may also apply to:

tyres;
mattresses;
soil;
clay;
sand;
concrete;
bricks;
masonry;
roof tiles;
large tree trunks;
tree stumps;
heavy green waste;
contaminated soil;
e-waste;
refrigerators and air-conditioning equipment;
gas appliances;
liquids; and
unusually heavy or dense materials.
Customers should disclose these items when requesting a quote.

7. ASBESTOS AND SUSPECTED ASBESTOS
Asbestos must be disclosed to Rov’s before any work begins.

If asbestos or suspected asbestos-containing material is discovered during work, Rov’s may immediately:

stop work in the affected area;
leave suspected material undisturbed;
restrict access to the affected area where reasonably necessary;
require the customer to arrange assessment, testing or removal by an appropriately qualified or licensed person;
cancel or postpone the affected work; and
provide a revised quote after the area has been made safe.
Rov’s employees or contractors are not required to handle material they reasonably suspect may contain asbestos unless the work is lawful, appropriately planned and expressly accepted by Rov’s.

Where asbestos was not disclosed and its presence results in additional attendance, delays, cleaning, decontamination, testing, specialist services, disposal charges or other costs, the customer may be charged reasonable additional costs attributable to the undisclosed material, to the extent permitted by law.

Nothing in these Terms requires Rov’s to transport, disturb or dispose of asbestos contrary to applicable work health and safety, environmental or waste laws.

8. CONTAMINATED LOADS
A load that contains prohibited or incorrectly classified material may be refused, rejected or reclassified by a waste facility.

If prohibited or undisclosed material placed or presented for collection by the customer causes:

a load to be rejected;
additional tipping fees;
contamination charges;
sorting costs;
testing costs;
quarantine requirements;
decontamination costs;
additional transport;
specialist disposal;
clean-up costs; or
other third-party charges,
the customer may be responsible for the reasonable additional costs attributable to that material, where permitted by law.

Rov’s may also stop work until an appropriate disposal method has been agreed.

ACCESS AND SITE CONDITIONS
9. SAFE AND REASONABLE SITE ACCESS
The customer must provide safe, reasonable and lawful access to the work area.

Before the scheduled work, the customer should advise Rov’s about:

narrow driveways;
low clearances;
steep driveways;
difficult access;
soft ground;
weight-restricted areas;
retaining walls;
septic systems;
underground tanks;
fragile paving;
recently installed driveways;
stairs;
lifts;
restricted loading areas;
parking restrictions;
strata requirements;
locked gates;
animals on the property; and
any other condition that may affect safe access.
If suitable access is unavailable when Rov’s arrives, Rov’s may alter the method of work, revise the scope, postpone the work or charge reasonable additional costs where additional labour, equipment or attendance is required.

10. DRIVEWAYS, LAWNS, PAVING AND OTHER SURFACES
Rov’s will take reasonable care when accessing a property.

However, trucks, trailers, excavators, bobcats and other machinery are heavy vehicles and equipment.

The customer must disclose any known concerns regarding:

weak or damaged driveways;
thin concrete;
cracked concrete;
unsupported paving;
soft lawns;
concealed drainage;
septic systems;
underground structures;
irrigation;
retaining structures;
recently laid surfaces; or
surfaces not designed for heavy vehicles or machinery.
Where the customer requests that Rov’s vehicles or machinery enter or travel across an area that may not be designed for their weight, Rov’s may refuse access or require an alternative method of completing the work.

Rov’s does not accept responsibility for deterioration arising solely from a pre-existing defect, weakness or condition that could not reasonably have been identified by Rov’s, except to the extent that loss or damage is caused by Rov’s failure to exercise due care and skill.

11. EXISTING PROPERTY DAMAGE
Customers should notify Rov’s of existing damage or particularly fragile areas before work begins.

Rov’s may photograph relevant areas before, during or after the work to document:

existing conditions;
access;
the work performed;
waste volumes;
safety concerns;
property condition; or
completion of the job.
These photographs may be retained as business records.

Photos identifying a customer or private property will not be used for promotional purposes where separate consent is reasonably required or has not been provided.

EXCAVATION AND EARTHMOVING
12. EXCAVATION AND MACHINERY WORK
Excavation and earthmoving involve risks that may not be visible from the surface.

Quotes for excavation work are generally based on reasonably observable conditions and information made available before work commences.

Unless specifically included in the quotation, Rov’s does not warrant that excavation work will be free from:

rock;
concrete;
buried structures;
roots;
groundwater;
contaminated material;
unstable ground;
underground waste;
unidentified services; or
other latent conditions.
Discovery of these conditions may require additional work, equipment or specialist advice and may result in a variation.

13. UNDERGROUND AND OVERHEAD SERVICES
The location of underground and overhead services is critical to safe excavation.

Rov’s will comply with applicable work health and safety obligations relating to excavation work.

The customer must disclose all known services and provide any plans, records or other information in their possession relating to:

electricity;
gas;
water;
sewer;
stormwater;
telecommunications;
irrigation;
private electrical cables;
private water lines;
pool plumbing;
septic systems;
drainage;
underground tanks; and
any other underground infrastructure.
Customers must particularly disclose private services, alterations or installations that may not appear on publicly available plans or utility searches.

Rov’s may require underground service information, service locating, potholing, scanning or further investigation before excavation begins.

If the location of a service cannot be confirmed to a level that allows work to proceed safely, Rov’s may suspend or refuse excavation in that area.

Where undisclosed private services or inaccurately located services are encountered, additional work or costs may apply.

14. ENGINEERING, SURVEYING AND STRUCTURAL ADVICE
Unless expressly stated in writing, Rov’s does not provide structural engineering, geotechnical engineering, land surveying, building certification or other professional engineering services.

Where work requires professional design, engineering, surveying, permits, certification or specialist assessment, responsibility for obtaining those services will be determined as part of the agreed scope.

Rov’s may decline to perform work where appropriate plans, approvals or professional advice have not been obtained.

CUSTOMER RESPONSIBILITIES
15. AUTHORITY TO REQUEST THE WORK
By engaging Rov’s, the customer confirms that they:

own the property; or
have authority from the owner, occupier, strata manager, property manager or other relevant person to authorise the work.
The customer must obtain any permission reasonably required for Rov’s to access the property and perform the agreed work.

If the customer does not own the property, they are responsible for ensuring the owner or relevant authorised person has approved the work.

16. ITEMS THAT MUST NOT BE REMOVED
This is particularly important for:

deceased estates;
end-of-lease clean-ups;
hoarder properties;
garage clean-outs;
storage areas;
office clear-outs; and
whole-property rubbish removals.
The customer is responsible for clearly identifying anything that must not be removed before Rov’s begins work.

Valuable, sentimental, confidential or important items should be removed from the work area or clearly separated from rubbish.

Where a customer instructs Rov’s to remove everything within a particular room, pile, area, container or designated waste zone, Rov’s is entitled to reasonably rely on that instruction.

Rov’s will exercise reasonable care but cannot be responsible for an item being removed where it was reasonably presented as rubbish or was located within an area that the customer specifically instructed Rov’s to clear, except to the extent that the loss results from a failure by Rov’s to exercise due care and skill.

Customers should check all waste thoroughly before collection.

17. OWNERSHIP OF ITEMS PRESENTED FOR REMOVAL
By identifying, placing, designating or otherwise presenting any item, material or waste to Rov’s for removal, the customer confirms that:

the customer owns the item or material, or has full authority from the lawful owner to authorise its removal and disposal;
the item has been intentionally designated for removal;
no other person has a legal claim to the item that would prevent the customer from authorising its removal; and
Rov’s may rely on the customer’s instructions when determining what is to be removed.
Once an item has been collected and removed from the property by Rov’s as part of the agreed service, the customer relinquishes possession of and, to the extent legally permitted, any ownership interest in that item.

Unless otherwise agreed in writing, items removed by Rov’s may be:

transported;
sorted;
separated;
recycled;
recovered;
donated;
reused;
repurposed;
resold; or
disposed of
at Rov’s discretion, subject to applicable law and waste disposal requirements.

The customer has no entitlement to the proceeds of any item that is lawfully reused, recycled, recovered, donated, repurposed or sold after it has been presented to and removed by Rov’s as waste or an item for disposal.

The customer has no right to demand the return of an item after it has been removed from the property.

If a customer advises Rov’s that an item has been removed in error, Rov’s may, where reasonably practicable and where the item remains identifiable and in Rov’s possession, attempt to locate or return the item.

Rov’s does not guarantee that an item can be recovered once removal has occurred, particularly where the item has been:

loaded with other waste;
transported;
mixed with other material;
transferred to another vehicle or facility;
recycled;
donated;
processed;
resold; or
disposed of.
Rov’s is not responsible for the removal or disposal of an item that was reasonably presented or identified as rubbish, waste or an item for removal, except to the extent that any loss results from a failure by Rov’s to exercise due care and skill.

If the customer instructs Rov’s to clear an entire room, area, pile, property, shed, garage, container or other designated space, Rov’s may reasonably treat items located within that designated area as authorised for removal unless the customer has clearly identified particular items that are to remain.

18. ITEMS BELONGING TO OTHER PERSONS
The customer must not instruct Rov’s to remove or dispose of property belonging to another person unless the customer has lawful authority to do so.

This includes property belonging to:

tenants or former tenants;
landlords;
family members;
beneficiaries of an estate;
executors or administrators of an estate;
former spouses or partners;
neighbours;
employees;
customers;
contractors; or
any other third party.
If a third party later makes a claim in relation to an item removed on the customer’s instructions, the customer may be responsible for reasonable loss or costs incurred by Rov’s arising directly from the customer having provided an instruction they were not authorised to give, to the extent permitted by law.

19. ITEMS OF POTENTIAL VALUE
Rov’s is engaged to provide removal and disposal services and is not responsible for appraising the monetary, collectible, antique, resale or sentimental value of items presented for removal.

Customers must inspect the work area and remove anything they wish to retain before Rov’s commences the relevant removal work.

Once an item has been authorised for removal, Rov’s is not required to determine whether that item may have:

resale value;
antique value;
collectible value;
scrap value;
sentimental value;
historical value; or
any other financial or personal value
before removing it.

The fact that an item is later found to have value does not alter the customer’s original instruction that it be removed.

20. NO RECLAIMING OR SORTING THROUGH WASTE AFTER LOADING
Once waste or an item has been loaded into a Rov’s:

truck;
trailer;
mobile skip bin;
machinery bucket;
container; or
other waste transport equipment,
customers and members of the public must not climb into, enter, sort through, remove items from or interfere with the load without the express permission of Rov’s.

This requirement exists for safety reasons.

Waste loads may contain:

broken glass;
sharp metal;
nails;
splinters;
unstable materials;
contaminated materials;
hazardous substances;
heavy objects; or
items that may shift without warning.
If a customer believes an item has been loaded by mistake, they must immediately notify a Rov’s team member.

Rov’s may decide whether it is safe and reasonably practicable to attempt to retrieve the item.

Rov’s employees are not required to unload, enter, climb into or sort through a waste load where doing so may create a safety risk.

Additional labour or disposal charges may apply where a customer requests that a load be unloaded or searched after loading has commenced and Rov’s agrees to do so.

21. PERSONAL INFORMATION AND DOCUMENTS WITHIN WASTE
Customers are responsible for securely destroying or retaining personal, confidential or sensitive documents before placing them in waste.

This includes:

identity documents;
financial records;
medical information;
photographs;
business records;
customer records;
legal documents;
computer storage devices;
mobile phones;
hard drives; and
other confidential material.
Unless a document destruction or secure data destruction service has specifically been agreed, Rov’s does not provide secure document or data destruction.

22. CHILDREN, PETS AND OTHER PERSONS
For safety reasons, customers must keep children, pets and persons not involved in the work away from operating machinery, vehicles and active work areas.

Rov’s may stop work if people or animals repeatedly enter an unsafe work zone.

Any delay caused by the site not being made reasonably safe may result in additional charges where additional labour or attendance is reasonably required.

SAFETY
23. RIGHT TO REFUSE OR STOP UNSAFE WORK
Rov’s places the safety of our employees, contractors, customers and members of the public first.

Rov’s may refuse, suspend or stop work if we reasonably believe:

the work is unsafe;
the site is unsafe;
hazardous material is present;
asbestos is present or suspected;
required safety information has not been provided;
a structure may be unstable;
machinery cannot safely access the site;
underground services cannot be adequately identified;
weather creates an unacceptable risk;
members of the public cannot be adequately protected;
animals create a risk to workers;
the requested work would breach a law, regulation or disposal requirement; or
continuing the work could cause serious property or environmental damage.
Stopping unsafe work does not mean Rov’s has agreed to rectify the underlying hazard.

A revised scope, specialist contractor, testing, assessment or other safety measures may be required before work can continue.

24. HAZARDOUS SITE CONDITIONS
The customer should tell Rov’s about any known hazard before the work begins.

This includes:

asbestos;
chemicals;
syringes;
biological waste;
aggressive animals;
unstable structures;
electricity hazards;
gas;
contaminated soil;
mould or significant biological contamination;
vermin infestations;
sharp objects;
unsafe structures;
fire damage;
flood damage; and
any other known hazard.
Failure to disclose a known hazard may result in suspension of the work and reasonable additional costs associated with making the situation safe or arranging appropriate specialist services.

PRICING AND PAYMENT
25. PRICING
The price payable is the amount stated in the accepted quote, booking confirmation, invoice or other written agreement, subject to any subsequently agreed variations.

Prices may be influenced by:

waste type;
waste volume;
waste weight;
disposal fees;
number of loads;
labour required;
machinery required;
distance;
accessibility;
dismantling requirements;
site conditions;
specialist disposal requirements; and
other factors relevant to the particular job.
Any GST treatment will be as shown on the relevant quote or invoice and as required by law.

26. WASTE VOLUMES AND WEIGHTS
Waste volume cannot always be accurately assessed from photographs.

Waste that appears to occupy a small area may be extremely dense or heavy, while bulky waste may be comparatively light.

Rov’s may charge according to the pricing method agreed for the job, including by:

volume;
weight;
load;
labour;
time;
machinery use;
disposal cost; or
a combination of these factors.
Where disposal facilities weigh a vehicle or load, the facility’s recorded weight may be used to determine applicable disposal charges.

27. ADDITIONAL CHARGES
Reasonable additional charges may apply where costs are incurred because of circumstances outside the agreed scope, including:

additional waste;
increased weight or volume;
additional loads;
additional labour;
additional machinery;
extended time on site;
restricted or inaccurate access information;
undisclosed stairs or carrying distances;
waiting time caused by site access issues;
prohibited or contaminated waste;
specialist disposal;
additional tipping fees;
load rejection;
unexpected hazardous material;
additional transport;
customer-requested variations; or
unforeseen conditions.
Where practicable, Rov’s will obtain the customer’s approval before incurring material additional charges.

28. PAYMENT
Payment must be made in accordance with the terms stated on the quote, invoice or booking confirmation.

Where payment is required on completion, payment is due when the agreed service has been completed.

Rov’s may require:

a deposit;
progress payments;
payment before disposal;
payment on completion; or
another payment arrangement
depending on the size and nature of the work.

Where an invoice remains unpaid after its due date, Rov’s may take reasonable steps to recover the debt and may seek recovery of reasonable debt recovery costs where permitted by law.

BOOKINGS, CANCELLATIONS AND DELAYS
29. SCHEDULING
Booking times are scheduled in good faith.

Rubbish removal, excavation and outdoor work can be affected by:

traffic;
previous jobs taking longer than anticipated;
weather;
machinery breakdowns;
disposal facility delays;
road closures;
emergencies;
unsafe conditions; and
other events outside Rov’s reasonable control.
If Rov’s becomes aware of a material delay, we will take reasonable steps to communicate with the customer.

Unless a specific completion time is expressly agreed in writing, scheduled arrival times should be treated as reasonable service windows rather than guaranteed minute-specific arrival times.

30. WEATHER
Rov’s may postpone or suspend work where weather conditions make work unsafe, impractical or likely to cause unreasonable property damage.

This may include:

heavy rain;
storms;
lightning;
extreme heat;
high winds;
flooding;
saturated ground; or
other hazardous conditions.
Where weather affects excavation or machinery access, Rov’s may wait for the ground or site to become sufficiently safe before continuing.

31. CANCELLATION AND RESCHEDULING
Customers should provide as much notice as possible when cancelling or rescheduling work.

A reasonable cancellation or rescheduling fee may apply where short notice results in costs that Rov’s has already incurred or cannot reasonably avoid, including:

allocated labour;
mobilisation;
travel;
machinery transport;
materials;
subcontractor costs; or
other committed costs.
Any applicable cancellation conditions stated in a quote, booking confirmation or service-specific terms will also apply.

Rov’s will not impose a cancellation fee greater than permitted by law.

DISPOSAL AND ENVIRONMENTAL COMPLIANCE
32. LAWFUL WASTE DISPOSAL
Rov’s aims to handle and dispose of waste responsibly and in accordance with applicable laws and facility requirements.

Waste will only be taken to facilities or destinations that Rov’s reasonably understands are authorised to receive the relevant waste.

Different facilities have different acceptance requirements.

Where a facility refuses or reclassifies waste because its actual contents differ from what was disclosed by the customer, additional costs may apply as set out in these Terms.

Nothing in these Terms transfers or removes any statutory responsibility that the law places on a waste owner, transporter, occupier or other person.

33. RECYCLING AND RESOURCE RECOVERY
Where reasonably practicable, Rov’s may separate or direct suitable material toward recycling, reuse, resale, donation or resource recovery.

Rov’s does not guarantee that every item capable of being recycled or reused will ultimately be recycled or reused, as this depends on:

contamination;
material condition;
available facilities;
commercial viability;
safety;
transport requirements; and
disposal facility requirements.

LIABILITY AND AUSTRALIAN CONSUMER LAW
34. AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law where that guarantee, right or remedy cannot lawfully be excluded, restricted or modified.

Where the Australian Consumer Law applies, Rov’s will provide services with the level of care and skill required by law.

35. CUSTOMER-CAUSED LOSS OR ADDITIONAL COSTS
To the extent permitted by law, the customer is responsible for reasonable loss, expense or additional costs suffered or incurred by Rov’s as a direct result of:

intentionally or negligently providing materially incorrect information;
knowingly failing to disclose hazardous material;
placing prohibited material into waste after being advised that it is prohibited;
instructing Rov’s to remove property the customer is not lawfully authorised to dispose of;
unauthorised use of Rov’s equipment;
deliberate damage to Rov’s equipment;
requesting Rov’s to perform work without the authority of the property owner or authorised occupier; or
a material breach of these Terms by the customer.
This clause does not apply to loss to the extent caused or contributed to by the negligence, unlawful conduct or breach of contract of Rov’s.

36. INDIRECT OR CONSEQUENTIAL LOSS
To the extent permitted by law, Rov’s will not be responsible for indirect or consequential losses that are not reasonably foreseeable as a result of the supply of the services.

Nothing in this clause limits liability that cannot legally be limited under the Australian Consumer Law or other applicable legislation.

MOBILE SKIP BINS
37. MOBILE SKIP BIN HIRE
Where the customer hires a Rov’s Mobile Skip Bin, the separate Mobile Skip Bin Terms & Conditions apply in addition to these general Terms & Conditions.

Those terms include specific requirements concerning:

hire periods;
bin capacity;
maximum weights;
loading;
prohibited materials;
additional disposal costs;
safe access;
movement of the trailer;
overfilling; and
responsibility for the equipment during the hire period.
Where there is an inconsistency relating specifically to Mobile Skip Bin Hire, the Mobile Skip Bin Terms & Conditions will apply to that service.

GENERAL TERMS
38. SUBCONTRACTORS
Rov’s may engage appropriately qualified employees, contractors or subcontractors to assist in providing services where reasonably required.

Rov’s remains responsible for its obligations to customers as required by applicable law.

39. PERMITS AND APPROVALS
The customer must advise Rov’s of any known site-specific approvals, strata requirements, building management requirements or restrictions relevant to the work.

Responsibility for council approvals, permits or other permissions will depend on the particular job and should be confirmed as part of the scope of works.

Rov’s may refuse to proceed where a legally required approval has not been obtained.

40. EVENTS OUTSIDE REASONABLE CONTROL
Neither party will be treated as having failed to perform an obligation solely because performance is prevented or materially delayed by an event outside that party’s reasonable control, subject to any rights that cannot be excluded under applicable law.

Such events may include:

severe weather;
natural disasters;
fire;
flooding;
road closures;
government restrictions;
disposal facility closures;
major equipment failure despite reasonable maintenance;
utility emergencies;
industrial action; or
other comparable events.
The affected party must take reasonable steps to minimise the impact of the event.

41. COMPLAINTS AND PROBLEMS
If you have a concern about work performed by Rov’s, please contact us as soon as reasonably practicable.

Prompt notification gives Rov’s the opportunity to inspect the issue and, where appropriate, discuss a suitable remedy.

Nothing in this clause limits your rights under the Australian Consumer Law.

42. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary or, if it cannot be read down, severed.

The remaining provisions will continue to apply.

43. NO WAIVER
If Rov’s does not immediately enforce a right under these Terms, this does not necessarily mean that right has been waived.

44. CHANGES TO THESE TERMS
Rov’s may update these Terms from time to time.

The Terms applying to a particular booking or service will generally be the Terms provided, accepted or published at the time the customer enters into that particular agreement, subject to any subsequent variation agreed between the parties and applicable law.

45. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.

CONTACT ROV’S

Matt from Rov’s Rubbish Collection recently helped us clear out 23 years worth of accumulated office junk, and we couldn’t be more impressed. From start to finish, he was professional, hardworking, and incredibly efficient. What seemed like an overwhelming task was completed far quicker than we expected, with absolutely no fuss.

Matts work ethic, professionalism, and environmentally conscious approach made the entire process stress-free. We would highly recommend Rovs Rubbish Removal to anyone looking for a reliable, efficient, and responsible rubbish removal service. Thanks again Matt!

A great team! Arriving at the agreed time with enough team members to get the job done quickly and safely. They showed great care to ensure no damage was caused to any parts of the property while removing bulky / heavy spa.

What a great service. The two guys arrived on time and were so energetic and easy to communicate with. Nothing was too much trouble. They took care with everything so that I was never concerned about my home or possessions. A truly smooth and pleasant experience at a very reasonable price. Thanks again!

Had the pleasure of dealing with Matt at ROV’s. Great guy with a great business. I really had no idea how much waste I had and the flexibility of their Mobile Skip bins made it very easy to just add to the pile. Matt was prompt and had had my rubbish gone very quickly. I highly recommend this business and will definitely be using them again.

I can highly recommend Rov’s Rubbish removals. Matt & his Dad assisted in removal of unwanted furniture from Mums unit at Reynolds Court Bateau Bay, during her transition into Nursing home care back in March. Matt responded to my messages in a prompt & timely manner & went out of his way to work into our timelines. His fee was fair & included tipping costs. He really helped take the stress out of a stressful time in our lives. Thanks Matt you are a true gem.

Matt did an amazing job transforming a weedy steep hillside into a terraced set of walking paths with his excavator and Bobcat – plus multiple loads of gravel. His expertise with the machines made quick work of the project, and his suggestions on how to prepare the paths properly were brilliant. I recommend him to anyone considering projects on the Central Coast!

Matt was exceptional to communicate and work with. He had an extremely complex situation, as there were multiple working parts that all had to align for him to carry out the job, but that is what he did. He was extremely accommodating, understanding and did a great job.
Thank you again Matt for all your help and patience.

My front and backyards were a complete overgrown disaster after months of neglect. I really wanted them cleaned up for Xmas and Matt & Dave and the team managed to juggle their other jobs to get it done. They worked through one of the hottest days in December – even though the final section (a clump of bamboo) turned out to be much harder than they expected.
10/10. Five stars. 100% effort and outcome.

I’ve had multiple great experiences working with Matt on site. He has successfully completed several projects with us, covering a wide range of works — from excavations and base preparation requiring intricate laser levelling, to rubbish and material removal services. His professionalism, attention to detail, and reliable service are greatly valued. I look forward to continuing to work with him on future projects.

Thank you Matt and Rov’s for assisting me with the removal of my bulk rubbish at my property. I was able to get a quick response on Sunday, the quote was very reasonable compared to alot of other quotes in the area, and they were able to pick up my bulk rubbish the next day (Monday morning). They also provided photos to confirm the job was done 🙂 I would highly recommend this business to others and will keep them front of mind for any future assistance.

We had two lives of 56 years to clear from our Mr fix it and keep everything elderly persons home. We were referred to Matt at Rovs… six loads later plus many extra tasks completed with ‘not a problem’ and ‘we can do that don’t worry’ and the house garage and four sheds are clear and clean as!

Thank you Matt Chris and team, would never have survived this without your honesty, integrity, consistent work and smiling faces.
